Terms & Conditions

Last updated: January 2025

1. Introduction

These Terms and Conditions govern the relationship between Sky Wild Safaris ("we", "us", "our") and you ("the client") when you enquire about, book, or travel on any safari or tour arranged by us. By making a booking with Sky Wild Safaris, you confirm that you have read, understood, and accepted these terms on behalf of yourself and all members of your travelling party.

2. Bookings and Confirmation

A booking is confirmed once we have received a completed booking form (or written confirmation via email or WhatsApp), a signed copy of these terms, and the required deposit. We will issue a written booking confirmation and invoice at this stage.

All bookings are subject to availability. Sky Wild Safaris reserves the right to decline any booking at its sole discretion.

3. Pricing and Payments

All prices are quoted in US Dollars (USD) unless otherwise specified. Prices include the services specified in your itinerary and exclude international flights unless explicitly stated.

Payment schedule:

We accept bank transfer and mobile money (M-Pesa). Payment details will be provided on your invoice.

4. Cancellation by the Client

All cancellations must be made in writing to info@skywildsafaris.co.ke. Cancellation charges are calculated from the date we receive written notice:

We strongly recommend purchasing comprehensive travel insurance that covers cancellation, curtailment, and medical expenses.

5. Cancellation or Changes by Sky Wild Safaris

In the unlikely event we need to cancel or materially change your trip due to circumstances beyond our control (force majeure, natural disaster, government restrictions, etc.), we will offer you an equivalent alternative itinerary or a full refund of monies paid. We will not be liable for any additional costs such as flights or accommodation booked independently.

6. Itinerary Changes

Safari itineraries are subject to change due to weather, wildlife movements, park regulations, road conditions, or other operational factors. We reserve the right to modify accommodation, routes, or activities to provide the best possible experience. Where changes are unavoidable, we will endeavour to offer alternatives of equal or higher standard.

7. Travel Insurance

Comprehensive travel insurance is mandatory for all Sky Wild Safaris clients. Your policy must cover, at minimum: emergency medical treatment and evacuation, trip cancellation and curtailment, personal liability, and loss of luggage. Proof of insurance may be required before departure.

8. Health and Fitness

It is your responsibility to ensure you are in adequate health to undertake the activities included in your itinerary. Please inform us of any health conditions, dietary requirements, or mobility limitations at the time of booking. For certain activities such as gorilla trekking or mountain climbing, specific fitness levels are required.

You are responsible for obtaining all required vaccinations and health documentation (including yellow fever certificates where applicable) prior to travel.

9. Liability

Sky Wild Safaris acts as an agent for various lodges, camps, transport operators, and other service providers. While we take the utmost care in selecting our partners, we cannot accept liability for any act, omission, or default by any supplier. Our total liability to you shall not exceed the total cost of your safari.

We are not liable for any indirect, special, or consequential losses, including loss of enjoyment, inconvenience, or loss of earnings.

10. Behaviour and Conduct

You are expected to behave responsibly and with respect for local cultures, wildlife, and the environment at all times. Sky Wild Safaris reserves the right to remove any client from a tour without refund if their behaviour is deemed dangerous, disruptive, or harmful to others, wildlife, or the environment.

11. Photography and Marketing

We may use photographs or videos taken during your safari for marketing purposes unless you advise us otherwise in writing before departure. All imagery will be used respectfully and in accordance with our Privacy Policy.

12. Governing Law

These Terms and Conditions are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.
